Contract Details

Section A: Coverage Outlines

The Home Warranty (referred to as “Warranty”) is between Canadian Insured Home Warranty(referred to as "we" or "us" or "our" or “Canadian Insured”) and the Applicant(s) (referred to as “you” or “your”) of the home specified in the application. The Home Warranty is administered by Canadian Insured Home Warranty Corporation. The Warranty covers the repair or replacement of covered eligible home systems and appliances, which experience a mechanical breakdown or malfunction down due to normal wear and tear during the term of the Warranty, so long as they...
a) Are located within the confines of the main foundation of the home (with exception of the air conditioning unit)
b) Become inoperative due to normal wear and tear
c) Are in good working order on the effective date of this Warranty. Any deficiency found as a result of a pre existing problem or lack of maintenance and will not be covered under the Warranty.
d) Properly installed throughout the term of this Warranty.
e) Breakdowns or failure are to be reported to our Claims Centre prior to having any work done, and all repair work and accompanied costs are to be approved by Canadian Insured Home Warranty.

Eligible Property Coverage: This Warranty covers single family homes, condominiums or townhouses which are used for residential purposes only. In reference to condominiums, this Warranty only covers systems, equipment or appliances that are contained within the interior of a condominium unit and excludes all equipment, items, or systems that are owned by the condominium association or designated as a condominium common area. This Warranty does not cover commercial structures or space or properties where commerce occurs, even though shared with covered residential unit(s). Items and services not specifically listed as covered are not covered. This Warranty covers the actual reasonable cost for repair or replacement of parts or components, as long as the repair or replacement is made necessary by operational failure of the parts or components occurring during the Warranty term. Repairs or replacements will be made with parts and materials of similar quality and kind to the covered eligible home systems and appliances. We are not responsible for matching colours. If an item or component is non-repairable due to the covered failure of an obsolete or unavailable component part, we will issue you a reasonable payment based on the estimated cost of repair (subject to any per occurrence or aggregate maximums),for you to put towards the repair or replacement of the home system or appliance in question. Further to this, we are not liable for delays in obtaining parts for any covered home system or appliance. When an equipment manufacturer is out of business, or no longer makes particular parts, or parts are otherwise unavailable, you will be allowed the estimated cost of the part. Please note that this Warranty does not apply to any breakdowns caused by or resulting from move related incidences. You are expected to ensure that all systems and appliances are in good working order and necessary repairs are made, as of the applicable date, as a condition of coverage. Maximum Claim: The maximum payment for the total of all covered repairs or replacement during the term of the Service Policy is limited to $10,000. Limits include all applicable taxes. Canadian Insured Home Warranty has the sole right to determine whether a covered eligible home system or appliance will be repaired, replaced or allowance offered.

Section B: Customer Service

When a covered eligible home system or appliance breaks down, you must call our Claims Department to report the breakdown before having any work done. We will verify that your Warranty is in effect, and will advise you to contact a Service Contractor or Maintenance company. We will not be responsible for any work done without prior notification and our authorization. You are not authorized to make any commitments or obligations on our behalf to the service contractor or any other person. Any costs or charges not specifically authorized by us will be solely your responsibility. The Warranty does not provide service work if you contact us after the Warranty has expired or has been cancelled, even if the breakdown occurred during the term of the Warranty. In emergency situations, whereby you experience a mechanical breakdown of a home appliance or system which makes your home uninhabitable, please proceed to have the problem repaired if it is outside our hours of business and the repair is of an emergency nature, example furnace quits working in the winter. Examples of non emergency would be an appliance not working, garage door not working, AC not working, etc.
Deductible: The repair costs including service charges under this Warranty are subject to a deductible of $50 for each breakdown on each covered eligible home system or appliance.

Section C: Eligible Home Systems & Appliances

1. HOME SYSTEM COVERAGE

A: Central Heating System
Covered: (max. one unit) Covers gas, oil or electric units. Portable or space heaters are not covered. Not Covered: Pipes or vents below or encased in concrete. Electric air cleaners, humidifiers, geo-thermal and solar heating systems and their components, fuel storage tanks, space heaters, chimneys, fireplaces, flue liners, air filters, gas logs, normal maintenance cleaning, adjustments. Heat exchangers are excluded from coverage.1. There is a maximum combined $2,000 limit on repairs to central heating systems and/or air conditioning systems.2. Boiler, steam, hot water or radiant heating systems, or components and accessories thereto shall be limited to a maximum coverage of $1,000.3. Heating systems in excess of 10 years of age are limited to $500 maximum allowance per term of the Service Policy.

B: Ductwork Covered:
Forced-air duct systems from heating and/or cooling unit to point of attachment at registers or grills, as well as metal venting for furnace air conditioning and water heaters. Not Covered: Ducts below or encased in concrete, or any dealings with asbestos or toxic materials, as well as gaining access to ductwork through walls, ceilings, floors or other confined areas.

C: Interior Plumbing System
Covered:
Interior water pipes, waste pipes, and sewer stoppages which can be cleared with no more than 100 feet of sewer machine cable from inside the home and permanently installed sump pumps, as well as plumbing components and parts within the toilet tank.
Not Covered: Pipes or plumbing lines outside the home or encased in concrete. Septic tanks and systems, ejector pumps, circulator pumps, water tanks, drain tile, pressure tanks, sewer and water laterals, connections and lawn sprinkling systems. Items related to well pumps, outdoor spas and swimming pools are excluded. Conditions of low or insufficient water pressure, colour or purity of water, water filters, and water purification systems, or repair of piping damage caused by roots. Shower base pans, wax ring seals, toilet fixtures and water tanks, shower enclosures or doors, sinks, tubs, fixtures,faucets, shower head and trip levers.

D: Interior Electrical System

Covered: Interior wiring, fuse or breaker panels, switches and receptacles.
Not Covered: Lighting and electrical fixtures, power vents, bathroom heaters and fans, telephones, low voltage wiring. Conditions of overload caused by inadequate wiring capacity, code violations, or any licensing permits.

E: Hot Water Heater
Covered:
Standard, gas or electric units. Not Covered: Oil, solar or tankless water heaters and their components. Hot water heaters in excess of 10 years of age are limited to $300 maximum allowance per term of the Warranty.

2. APPLIANCES COVERAGE

All covered appliances, including garage door opener and central vacuum in excess of10 years of age are limited to $300 maximum allowance per term of the Warranty.

a) Primary Refrigerator
Covered: All major parts and components for one (1) unit only including motors and compressors, fans, freezer sections, and doors.
Not Covered: seals, gaskets, shelves, racks, ice makers / crushers, dispenser mechanisms, food spoilage, and interior thermal shells, and door liner.

b) Dishwasher
Covered: All major parts and components for one (1) kitchen unit only.
Not Covered: Rollers, racks, baskets, portable units.

c) Food Waste Disposer
Covered: All major parts and components for one (1) kitchen unit only.
Not Covered: Stoppage caused by unsuitable foreign material.

d) Stove/Oven/Cooking Range
Covered: All major parts and components for one (1) kitchen unit only, including self cleaning mechanisms and timers (when timer affects functioning of oven).
Not Covered: Commercial equipment, box, door glass, lights, rotisseries, racks, handles, knobs, and filters.

e) Built-in Microwave Oven
Covered: All major parts and components, includes touch pad panel for one (1) kitchen unit only.
Not Covered: Door glass, interior lining, clocks, lights, shelves, rotisseries, meat probe assemblies, and countertop or portable microwave ovens.

f) Garage Door Openers (up to 3 units)
Covered: All major parts and components.
Not Covered: Failure caused by improper installation, transmitters, misplaced remote controllers, and damage to automobiles, exterior touch pads and springs.
g) Central Vacuum System
Covered: All major parts and components.
Not Covered: Conditions of inadequate capacity, cleaning accessories including hoses, power heads, all non-installed items or clogged lines.

Section D: Optional Coverage (if purchased)

1. CLOTHES WASHER AND DRYER

Covered: (max. one washer and dryer) All major parts and components, including gas or electric dryers, electric washers, controls, and electrical connections.
Not Covered: Venting, detergent dispensers, mini-tubs, filter/lint screens, knobs and dials, clothing damage. Washers & dryers in excess of 10 years of age are limited to$300 maximum allowance per term of the Warranty.

2. CENTRAL AIR CONDITIONING

Covered: (max. one unit) Electric forced-air central air conditioning or evaporative cooler systems.
Not Covered: Registers and grills, condenser casings, filters and water towers, “Package” heat-A/C units, and window air conditioners. Normal maintenance, cleaning, adjustments and capacity increases. Geo-thermal systems and cooling systems with compressors larger than five tons. There is a maximum combined $2,000 limit on repairs to central heating systems and/or air conditioning systems. Air conditioning units in excess of 10 years of age are limited to $500 maximum allowance per term of the Warranty.

Section E: Additional Exclusions


A: The Warranty will not provide coverage for:

a) Any home system and appliance that is not in proper working order on the date of warranty purchase and/or effective date of coverage.

b) Any home system or appliance not listed in the Warranty, or not checked on the Application, or any commercial system or equipment used for non-domestic purposes.

c) Any home system or appliance or equipment leased by or otherwise not owned by you.

d) Any home system or appliance or equipment which breaks down due to lack of capacity, maintenance inspections, cleaning, adjustment and lubrication services. Lack of adequacy, efficiency or capacity of any system: due to low water volume or pressure; undersized equipment; improper installation; mineral or dirt build-up resulting in impurity or discoloration of water.

e) Excessive or inadequate water pressure, code violations, electrical surge, excessive or inadequate voltage, electrical currents artificially generated, electrical wiring not to code.

f) Roofs, flashing, eaves, down spouts, walls, doors, ceilings, windows, slabs, foundations or basement walls or any structural items.

g) Any home system or appliance or equipment, pipe or system containing or covered by asbestos.

h) Water seepage due to outside flow, including backup through sewers or drains or any equipment or system below or encased in concrete.

i) Any issues pertaining to rust or corrosion.

j) Any utility lines, sewer or piping outside the home, including: power lines, underground wiring, water lines, or natural gas lines to the residence. Pressure regulators inside or outside the home, collapse of piping, damage caused by roots, sewer stoppages which cannot be cleared with up to 100 feet of sewer machine cable from inside the home.

k) Adaptive, consequential or connective items which have not failed but may be replaced when installing a failed item.

l) Any light bulbs, filters, pulleys, belts, Freon, lubricants or other cleaning or general maintenance type items or charges.

m) Heating and/or cooling units used for any building other than the actual resident structure; such as a garage, porch, carport or shed.

B: The Warranty does not cover the cost of repair or service of any covered eligible home system and appliances which fails or malfunctions under the following circumstances:

a) Any covered eligible home system or appliance which has been altered or improperly installed, maintained, or serviced.

b) Any covered eligible home system or appliance which has been added to or enlarged after the commencement date of the term of the Warranty, or subjected to extraordinary or non-intended use.

c) Any covered eligible home systems or appliance for which the electric voltage, power or gas supply is inadequate, or for which the plumbing outside the residence has failed.

d) Clogging of garbage disposal or drains with unsuitable foreign matter.

e) Acts of God, outside perils, wind, rain, freezing, lightning, mischief, misuse, vandalism, secondary or consequential damages, accidents and occurrences outside normal use and service, or breakdown which typically may be covered by extended coverage homeowner's insurance.

f) Damage to the physical structure of the residence including, but not limited to, bearing walls, walls, roof, roof supports, structural floor base, foundation or slabs, and ceilings.

g) Faulty workmanship by any contractor trade-person selected and hired, or any improper installation of any component or system by the owner, seller or any other person, either before or after issuance of this Warranty.

h) Defects in the equipment due to the manufacturer’s errors or improper construction of the equipment.

i) Permits, fees, cost of disposal of any replaced or repaired item, and fees or work associated with gaining access to appliances or systems.

j) Failure to provide timely service due to conditions beyond our control, including but not limited to part or equipment delays, labour difficulties etc.

k) Any expenses related to asbestos materials, toxic chemicals, radon, dioxin, or Freon.

l) Non-functional parts, including damage to cabinetry, light bulbs, plastic, porcelain or enamel parts, exterior/interior finishes, knobs, dials, hinges, lock and key assemblies, handles.

m) racks, baskets, probes or rotisseries, trim and/or appearance parts AND ALL ITEMSNOT LISTED AS COVERED.

Section F: Warranty Regulations


Cancellation Policy: This Warranty may be cancelled, upon your request, provided that a written notice of cancellation is submitted to Canadian Insured Home Warranty within the first 30 days of purchase. Your coverage with Canadian Insured Home Warranty will be cancelled immediately following receipt of a request for cancellation letter or email. Upon cancellation of coverage, you are entitled to a full refund of the paid Warranty premium for the unexpired term; less a $50 administrative charge. If there have been any claims paid to date the warranty is non transferrable and may not be cancelled. Canadian Insured Home Warranty reserves the right to cancel the Warranty in the case of fraud or misrepresentation of facts.
Transferring Coverage: If the covered property changes ownership during the Warranty term, please contact Canadian Insured Home Warranty for further information to transfer existing coverage to a new property, subject to a $100 transfer fee.
Other Coverage: No repairs or replacement to any covered eligible home systems and appliances will be made under the Warranty unless and until all repairs or replacement covered by any manufacturers warranty, guaranty, policy of insurance or other contracts have first been provided. You agree to do all that is necessary to effectuate all such repairs or replacements.
